</script></div><p>When deciding whether or not bankruptcy is your best or only option, there are many questions you need to ask yourself. Is it okay to go Bankrupt? What do I have to do to go Bankrupt? Will I lose everything? Is the Bankruptcy process painful or humiliating?<br />
These are all valid questions, but what is more important is that you find the answers and face up to them. <p>Is it okay to go bankrupt?<br />
In recent years you may have noticed that there isn&#8217;t as much stigma attached to being in debt, so doesn&#8217;t it stand to reason that there will be more people who are unable to repay their debts and go into bankruptcy, the stigma attached to bankruptcy will subside also? Judges and other legal reps such as the Official Receiver are generally sympathetic, as these are not criminal proceedings.</p>
<p>What do I have to do to go bankrupt?<br />
The first thing to do is to go to your local County Court and ask for a bankruptcy pack. You will also need a fee of just under £500 to cover the overall cost of going bankrupt. With the completed bankruptcy pack and fees return to the County Court, you should set aside a day or so. After a brief chat with a Judge, based on your circumstances they will create the bankruptcy order. You then go to the Official Receiver, who will ask you about your income and circumstances and give you some more forms to fill in. That&#8217;s it!</p>
<p>Usually a bankruptcy order lasts for only 12 months, compared to 60 for an IVA. You&#8217;ll be glad you chose to go bankrupt declare help and start again.</p>

Credit card debt is a main cause of bankruptcies in the United Kingdom, due to many years of cheap and easy credit being handed out by the banks and other lending institutions. On our doormats every day there would be junk mail stating pre approved for a credit card,  ie pre approved for credit card debt. At school we were never taught about APR&#8217;s, compound interest, budgeting or the lifetime of debt that awaits us once we start working (albeit not for a minority). And now , with the economy slowing down, industry is about to start shedding jobs leading to masses who will be unable to afford their repayments. This is sure to lead to a massive rise in bankruptcies unless the economy returns to more solid ground. For many people it is already too late - they are unable to manage their debt repayments, and so by delaying  <a href="http://www.bankruptdeclarehelp.com">declaring help  to go bankrupt</a>, they are inevitably making things worse in the long run. This can happen by juggling credit card repayments leading to insurmountable interest charges, creating further self perpetuating credit card debt. Once Bankruptcy proceedings begin it is generally necessary to explain in court how debts were accumulated. If a judge or magistrate believes that the bankruptee was irresponsible, the bankruptcy order can be extended beyond the normal 1 to 3 years. Thinking of going <a href="http://www.bankruptdeclarehelp.com">bankrupt? declare help</a> by seeking independent advice from the Citzens Advice Bureau, National Debt Helpline on 0808 808 4000 or contact the Consumer Credit Counselling Service. If you do decide to go ahead with the bankruptcy you will need to fill out a debtor&#8217;s petition form, available at <a title="https://www.insolvencydirect.gov.uk/isolv/" href="https://www.insolvencydirect.gov.uk/isolv/" target="_blank">https://www.insolvencydirect.gov.uk/isolv/</a> (note you have to register with the site first). The petition must be taken to your nearest County Court (make sure that they have bankruptcy jurisdiction) and a fee of £120 - £150 pounds must be payed when submitting the bankruptcy petition (nOte that this fee can be waived under certain circumstances, such being on income support), but a further fee of £345 to the Official Receiver must be paid also, and this cannot be waived. Please note that married couples where both are applying for bankruptcy must each pay these fees. Business partners must also pay fees separately unless applying for joint bankruptcy.</p>
<p>What happens then?<br />
An Official Receiver is appointed as trustee of your bankruptcy affairs and to protect your assets. An Insolvency  Practitioner is appointed to sell your assets in order to pay off your creditors.Once the bankruptcy proceedings begin You must provide full details of all income, debts and assets to the court appointed Official Receiver within 21 days. You may also have to explain the circumstances of your debts to the Court to satisfy that you have not been reckless financially. Any assets you have must then be handed over to the Official Receiver and you must adhere to the strict rules laid out by the Courts. You will not be able to use and bank or building society account, borrow any money above £250 without first informing you are bankrupt. At this stage you become free from pursuit of said creditors for your outstanding debts. The bankruptcy order will last usually between 1 and 3 years, but can last longer if the Courts feel  that the Bankrupt party has been dishonest or reckless in running up their debt</p>
